Asylum
Individuals who are unwilling to return to their country because they have been or fear they will be persecuted on account of their race, religion, nationality, political opinion or membership in a social group can apply for asylum. The persecution must be by the government or someone the government is unwilling or unable to control.
Individuals must apply for asylum within one year of entering the U.S., although exceptions may be made where circumstances in the country have changed. Individuals may include their spouse and children who are in the U.S. on the asylum application as derivatives. Asylum may be granted by Citizenship and Immigration Services or an Immigration Judge during removal proceedings.
If asylum is granted, the individual will receive work authorization and may apply for permanent resident status after one year. The asylee may also petition for a spouse and children (unmarried and under 21) within two years of receiving asylum.
Nunc Pro Tunc Asylum for Derivatives
In some cases, individuals who received asylum through a spouse or parent may need to apply for nunc pro tunc asylum before applying for a permanent resident card. For example, a wife who received asylum through her husband and is now divorced must first apply for asylum on her own. If asylum is approved, it is retroactive and dated back to the original grant of asylum. The asylee may then apply for permanent resident status.
