Refugee and Asylee Adjustment of Status
Refugees and asylees are elgible for a green card one year after entering the U.S. or receiving asylum. Refugees must apply for a green card after one year. Asylees do not have to apply for a green card; however, you may lose your status if you remain an asylee and conditions change in your country.
Nunc Pro Tunc Asylum
In some cases, individuals who received asylum through a spouse or parent may need to apply for nunc pro tunc asylum before applying for a permanent resident card. For example, a wife who received asylum through her husband and is now divorced must first apply for asylum on her own. If asylum is approved, it is retroactive and dated back to the original grant of asylum. The asylee may then apply for permanent resident status.
